By using this website or engaging our services, you agree to these Terms. If you do not agree, please do not use the website or our services.
Where you and Darsh Media sign a separate quotation, proposal, work order or agreement for a project, its terms apply to that project and take precedence over these Terms where they differ.
2. Our services
We provide video and media production, election and political campaigning, outdoor advertising, digital marketing and social media, bulk communication and outreach, event management, and campaign war room operations. Service descriptions on this website are for general information. The exact scope, deliverables, timelines and fees for any project are set out in the written quotation or agreement for that project.
3. Use of this website
- You may use this website for lawful purposes only.
- You must not attempt to gain unauthorised access to the website, its administration area or its servers, upload malicious code, or interfere with its operation.
- You must not copy, scrape or republish website content, portfolio images, videos or documents without our written permission.
- Information you submit through our forms must be accurate and must belong to you or be shared with the necessary permission.
4. Quotations and engagement
Quotations are valid for 15 days from the date of issue unless stated otherwise. Prices for media space, printing, venues, equipment, advertising platforms and other third-party items depend on availability and may change until confirmed. A project begins once you approve the quotation in writing (including by email or WhatsApp) and we receive the advance payment.
5. Fees and payment
- Unless your quotation says otherwise, 50% of the project fee is payable in advance and the balance is payable before final delivery, go-live or the event date, as applicable.
- Third-party costs such as outdoor media bookings, ad-platform spend, printing, venue charges and bulk messaging credits may need to be paid in full in advance.
- All fees are exclusive of GST and other applicable taxes, which will be charged extra.
- Invoices are payable within 7 days unless agreed otherwise. If a payment is overdue, we may pause work, withhold deliverables or suspend running campaigns until it is cleared, and project timelines will move accordingly.
- Work outside the agreed scope, extra revision rounds and changes after approval will be quoted and billed separately.
6. Cancellation and refunds
- You may cancel a project by written notice. Once work has started, the advance payment is non-refundable.
- You will pay for work completed up to the date of cancellation and for any third-party costs already paid or committed, including non-cancellable media, venue and vendor bookings.
- Postponement of an event or campaign is subject to the availability of vendors, sites and crew, and any rescheduling charges they apply.
- Where a refund is due, it will be processed within 15 working days to the original payment method, after deducting the amounts above.
7. Client responsibilities
To deliver your project on time, you agree to:
- Provide accurate briefs, content, logos, photos, data and approvals on time.
- Ensure that all material you supply is lawful, accurate and does not infringe anyone else's rights, and that you hold the permissions needed to use it.
- Review and approve drafts within agreed timelines. Delays in feedback or approvals will extend delivery dates.
- Treat our team, crew and vendors with respect and provide safe working conditions at your venues and locations.
8. Election and political campaigns
For election and political work:
- The candidate or party is responsible for complying with the Model Code of Conduct, Election Commission of India guidelines, expenditure limits and reporting, and all applicable election laws.
- Political advertisements that require pre-certification (for example, by the Media Certification and Monitoring Committee) must be certified before release. We can help prepare the material, but final approval and responsibility rest with the client.
- The client is responsible for the claims, statements and content of campaign material. We may refuse or withdraw any content we reasonably believe is unlawful, defamatory, misleading, or likely to incite hatred or violence.
- We will provide invoices and expenditure details needed for the candidate's election accounts.
9. Bulk communication campaigns
- Where you provide contact lists, you confirm that the data was collected lawfully and that recipients have given any consent required for the communication.
- Where Darsh Media sources contact data, it will be used only for the agreed campaign and may not be resold or reused by the client without our written consent.
- All SMS, WhatsApp and voice campaigns must use approved sender IDs, headers and templates and comply with TRAI regulations, DLT requirements, telecom operator rules and WhatsApp Business policies. Template approval, delivery rates and timing depend on operators and platforms and are outside our control.
- We may decline or stop any campaign that we reasonably believe breaches the law or platform policies.
10. Intellectual property
- Once we receive full payment, you own the final approved deliverables created specifically for you, for the uses agreed in the quotation.
- Unless agreed otherwise, raw footage, working and source files, templates, tools, methods and unused concepts remain the property of Darsh Media.
- Third-party material such as stock images, music, fonts and software is licensed under its own terms, which you must follow.

- All content on this website, including text, graphics, logos, images and videos, belongs to Darsh Media or its licensors.
11. Third-party platforms, media and results
- Our work relies on platforms and partners such as Meta, Google, YouTube, WhatsApp, telecom operators, media owners, printers and venues. Their policies, outages, rejections, account restrictions or price changes are outside our control.
- Outdoor advertising sites are subject to availability and to permissions from local authorities and site owners. If a confirmed site becomes unavailable, we will offer a comparable alternative or an adjustment for the affected period.

12. Confidentiality
Each party will keep confidential any non-public information received from the other in connection with a project, and use it only for that project. This does not apply to information that is already public, independently developed, or required to be disclosed by law or by an authority.
13. Limitation of liability and indemnity
To the maximum extent permitted by law, Darsh Media is not liable for any indirect, incidental, special or consequential loss, including loss of profit, revenue, data, goodwill or electoral outcome. Our total liability for any claim relating to a project is limited to the fees you have paid us for that specific project.
You agree to indemnify Darsh Media against claims, losses and costs arising from material or data you supplied, your breach of these Terms, or your breach of any law, including election, advertising, telecom and data protection laws.
